Terms of Service

These Terms of Service ("Terms") govern your access to and use of TaskEase, a product of CyberCure Technologies Private Limited ("Company," "we," "our," or "us"). By accessing or using TaskEase, you agree to be bound by these Terms.

If you are using TaskEase on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

1. Description of Service

TaskEase is a cloud-based enterprise workforce and security management platform offering modules including but not limited to: TimeSheet, Project Management, CRM (Customer Relationship Management), DLP (Data Loss Prevention), Accounts, Asset Management, Leave Management, and Attendance Tracking.

The CRM module includes integration with Meta (Facebook) Lead Ads, allowing subscribers to automatically receive lead data from their Facebook and Instagram advertising campaigns.

2. Account Registration

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• Each account is for a single company/organization (multi-tenant environment)

3. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the platform or other accounts
• Transmit any viruses, malware, or malicious code
• Reverse engineer, decompile, or disassemble any part of the platform
• Use the platform to store or transmit infringing, defamatory, or unlawful content
• Resell or redistribute access to the platform without written authorization
• Use automated means to access the platform in a way that exceeds reasonable usage

4. Meta / Facebook Integration

When you use the CRM module's Facebook Lead Ads integration, you additionally agree to:

• Comply with Meta's Terms of Service and Meta Platform Policy
• Use lead data received through Facebook Lead Ads only for legitimate business purposes
• Not use lead data for spam, unsolicited communications, or any purpose prohibited by Meta's policies
• Ensure that your use of lead data complies with all applicable privacy laws including GDPR, IT Act 2000 (India), and PDPB
• Obtain proper consent from leads as required by applicable laws before contacting them
• Only connect Facebook Pages that you own or have explicit authorization to manage

We act as a data processor on your behalf for Facebook lead data. You are the data controller and are responsible for how lead data is used within your organization.

5. Subscription and Payment

• Access to TaskEase requires an active subscription
• Subscription fees are billed as agreed at the time of purchase
• All fees are non-refundable unless otherwise specified in writing
• We reserve the right to modify pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account

6. Data Ownership and Privacy

You retain all ownership rights to your data stored within TaskEase. We do not claim ownership of your business data, leads, or any content you upload. Our collection and use of data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

TaskEase and all related trademarks, logos, software, and content are the exclusive property of CyberCure Technologies Private Limited. Nothing in these Terms grants you any rights to use our intellectual property except as expressly permitted.

8. Availability and Uptime

We strive to maintain high availability of the platform but do not guarantee uninterrupted service. We reserve the right to perform maintenance, updates, or modifications that may temporarily affect availability. We will provide reasonable advance notice for planned downtime.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CyberCure Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of TaskEase. Our total liability for any claim shall not exceed the amount you paid in the three months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless CyberCure Technologies and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

11. Termination

Either party may terminate the service agreement with 30 days' written notice. We may suspend or terminate your account immediately for violation of these Terms, non-payment, or activities that may harm the platform or other users. Upon termination, your data will be retained for 30 days before deletion, during which you may request an export.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or in-app notification with at least 14 days' notice. Continued use after changes take effect constitutes acceptance of the revised Terms.
